Please read carefully the following (1) PROGRAM RULES, POLICIES AND PROCEDURES; (2) ASSUMPTION OF RISK/WAIVER OF LIABILITY/COVENANT NOT TO SUE/ AGREEMENT TO INDEMNIFY/CONSENT TO USE OF LIKENESS; and (3) CONSENT TO BACKGROUND CHECK, which must be accepted and agreed to as part of the paperless registration process.

PROGRAM RULES, POLICIES, AND PROCEDURES

Participation in the Cooperstown Dreams Park, Inc. (“CDP”) Umpire Program is on a volunteer basis. A request to participate in CDP's Umpire Program does not constitute an application for employment. Umpire participants acknowledge and agree that they are not employees or independent contractors of Cooperstown Dreams Park and will receive no remuneration from CDP.

All potential participants must complete a participant profile. Selected participants will be provided with an individual, date-specific Certificate of Participation that must be presented at Registration. The Certificate of Participation is non-transferable. CDP prohibits the use of any Certificate of Participation for promotion, or solicitation, either directly or on a third-party website.

A request to participate in CDP's Umpire Program, whether such request is made by a proposed umpire or by a participating team, does not guarantee participation by that umpire. Team referrals are not guaranteed, and selection/receipt of Certificate of Participation is not guaranteed. Cooperstown Dreams Park reserves the right, at any time, to remove a selected umpire participant from a team's profile.

Umpire participants are capped at two sessions per season. In the event CDP receives fewer volunteer applicants or team referrals to cover all sessions in any given season, additional sessions will be assigned to willing participants in order of seniority. Seniority is defined by the number of sessions of past participation in CDP's Umpire Program.

Selected participants must pass a background check as required by New York State children's camp guidelines.

I understand that my participation in the CDP Umpire Program may be suspended or terminated for violation of Cooperstown Dreams Park rules, policies, and procedures.

Umpire participants must act in a professional manner at all times. Umpiring is often a trying position, which requires the exercise of much patience and good judgment. Umpire participants must be courteous, impartial, and firm. Umpire participants must maintain temper and self-control at all times. The use of profanity is prohibited.

Umpire participants must remain in proper uniform while participating in games and ceremonies and must keep the uniform in good condition.

Umpire participants must be ready for transport to the ball field 30 minutes prior to the start of each game.

The use of cell phones and electronic devices is prohibited while participating in events or on the field.

Cooperstown Dreams Park strives to provide a smoke-free facility for the benefit of all players and guests. For that reason, smoking is allowed in designated areas ONLY. NO SMOKING OR SMOKELESS TOBACCO IS ALLOWED INSIDE OF BALL FIELDS OR IN THE BASEBALL VILLAGE. This rule is strictly enforced!

Alcoholic beverages are prohibited at all times and will be confiscated. Anyone possessing alcoholic beverages will be asked to leave the facility.

Umpire participants must make safety a priority, both on the field and off.

ASSUMPTION OF RISK/WAIVER OF LIABILITY/COVENANT NOT TO SUE/AGREEMENT TO INDEMNIFY/CONSENT TO USE OF LIKENESS

I understand and acknowledge that baseball is a vigorous team sport at times involving severe cardiovascular stress and violent physical contact. I understand that baseball involves certain risks, including but not limited to cardiac arrest, death, serious neck and spinal injuries resulting in complete or partial paralysis, brain damage, and serious injury to virtually all bones, joints, muscles, and internal organs, and that equipment provided for my protection may be inadequate to prevent serious injury. I further understand that baseball involves a particularly high risk of ankle, knee, head, and neck injury. In addition, I understand that participation at Cooperstown Dreams Park involves activities incidental thereto, including but not limited to, travel to and from the site activity, participation at sites that may be remote from available medical assistance, and the possible reckless conduct of other participants, campers, and guests.

Notwithstanding the risk, I am voluntarily participating in CDP's Umpire Program with knowledge of the danger involved and, by clicking the "Accept" button below, I hereby agree to accept and assume any and all risks and dangers of my presence and participation at Cooperstown Dreams Park, including but not limited to the risk of property damage, personal injury, infectious diseases, such as flu/Covid-19, or death.

By clicking the "Accept" button below, and in consideration of my being allowed to attend and participate in Cooperstown Dreams Park programs, related events, and activities, I hereby agree, on behalf of myself, my estate, my heirs, and my personal representatives or assigns, to fully and forever discharge and release Cooperstown Dreams Park, Inc. and all of its affiliates and sponsors, the owners and lessors of the real property, and their respective owners, partners, agents, operators, managers, employees, volunteers, and representatives (“Released Parties”) from any and all present and future claims resulting from ordinary negligence on the part of the Released Parties for property damage, personal injury, or wrongful death, arising as a result of my presence at and participation in Cooperstown Dreams Park programs and activities incidental thereto, wherever, whenever, or however the same may occur.

I acknowledge and agree that Cooperstown Dreams Park and the Released Parties are not responsible for any injury and/or illness (or loss of property) to any person suffered while playing, practicing, or in any other way involved in Cooperstown Dreams Park activities for any reason whatsoever, including ordinary negligence.

I further agree to indemnify and hold harmless Cooperstown Dreams Park and all Released Parties for any and all claims arising as a result of my engaging in or receiving instruction in Cooperstown Dreams Park programs and activities or any activities incidental thereto, wherever, whenever, or however the same may occur. I have adequate personal health or athletic participant liability insurance to cover my participation while at Cooperstown Dreams Park.

I give Cooperstown Dreams Park, Inc. or its designee the irrevocable right to take and use my name, picture, likeness, photograph, film, videotape, interviews, and/or verbal statement in all forms and media and in all manners for any advertising, promotional, Internet (website, webcasting and broadband broadcasting), TV, and/or publicity purposes of Cooperstown Dreams Park, Inc. I waive any rights I may have in connection with any use of the material, including any right to inspect or approve the finished use, including any written copy that may be created in connection with such use.

I understand that this Assumption of Risk/Waiver of Liability/Covenant not to Sue/Agreement to Indemnify/Consent to Use of Likeness is intended to be as broad and inclusive as permitted by the laws of New York and agree that if any portion is held invalid the remainder of the waiver will continue in full legal force and effect. I further agree that the venue for any legal proceeding between myself and any of the Released Parties shall be in the state of New York.

I understand and acknowledge that Cooperstown Dreams Park is committed to providing a positive, safe, and supportive environment where participants are free from bullying, harassment, and discrimination. I agree not to engage in negative or hurtful conduct or expressions (verbal or non-verbal) based on a person's actual or perceived race, color, weight, national origin, ethnic group, religion, religious practice, disability, sexual orientation, gender, sex, or political affiliation. I agree to promote an atmosphere of dignity and respect and will not tolerate bullying, harassment, or discrimination of any kind. I further understand that racial and sexual harassment and the use of racist, ethnic, or sexist slurs of any kind are strictly forbidden, and that taunting and bullying are strictly forbidden. I agree to refrain from provocative behavior and avoid confrontation with others on baseball-related and non-baseball-related topics, including provocative political speech. I understand that verified instances of a violation of this policy will result in ejection and/or suspension of the participants (players, parents, or coaches) involved in the incident and may result in cancellation of a team's placement, revocation of grandfather status, and/or removal from Cooperstown Dreams Park.

CONSENT TO BACKGROUND CHECK

As a condition of being a participant at Cooperstown Dreams Park, I give Cooperstown Dreams Park, Inc. permission to conduct a background check on me, which may include a review of sex offender registries, child abuse, and criminal history records. I understand that if selected for the Umpire Program, my status is conditional upon Cooperstown Dreams Park receiving no inappropriate information on my background. I hereby release and agree to hold harmless from liability Cooperstown Dreams Park, and the Released Parties, or any other person or organization that may provide such information from any claims arising out of the background check or the use of information provided in connection with the background check.

I affirm that I have never been convicted of a felony or do not presently have a criminal action pending against me.
